1. Introduction and Scope
This Acceptable Use Policy ("AUP") governs your use of the RIG53 platform — including the website at rig53.com, the RIG53 mobile application, APIs, and all associated services (collectively, "the Platform") — operated by RIG53, Inc., a Delaware corporation ("RIG53," "we," "us," or "our").
By accessing or using the Platform, you agree to comply with this AUP. This AUP is incorporated by reference into the RIG53 Terms of Service. In the event of a conflict between this AUP and the Terms of Service, the more restrictive provision applies. This AUP applies to all users including drivers, carriers, brokers, shippers, dispatchers, and all other registered users.
RIG53 is a neutral platform facilitating connections in the commercial trucking industry. We do not employ users, own freight, or operate as a carrier. Maintaining the integrity, safety, and lawfulness of the Platform depends on every user's cooperation with this AUP.
2. Acceptable Uses
You may use the Platform only for lawful purposes and in accordance with your registered role and the applicable permissions granted by RIG53. Permitted uses include:
Posting and accepting freight loads, job listings, or equipment listings in your registered capacity;
Searching and responding to loads, jobs, or listings relevant to your role;
Managing your Driver Qualification (DQ) file, credentials, and compliance documents;
Communicating with other verified users through the Platform's messaging system;
Sharing professional industry content via the social feed;
Accessing and using analytics, reporting, and fleet management tools available to your subscription tier;
Participating in the RIG53 gamification system, earning and spending platform credits per the Platform Credits Policy;
Connecting with other users for professional networking purposes.
3. Prohibited Conduct
The following conduct is strictly prohibited on the Platform. Violations may result in immediate account suspension, termination, and potential legal action.
3.1 Illegal Activity
Using the Platform to facilitate any activity that violates federal, state, or local law;
Transporting, brokering, or listing prohibited cargo (including but not limited to controlled substances, weapons, or contraband);
Operating as a carrier, broker, or dispatcher without the required FMCSA authority, licenses, or insurance;
Submitting falsified, forged, or fraudulently altered credentials, CDL records, DQ documents, or insurance certificates;
Engaging in wire fraud, mail fraud, or any form of commercial fraud through the Platform.
3.2 Fraud and Misrepresentation
Creating multiple accounts to circumvent suspensions, rate limits, or access restrictions;
Impersonating another user, carrier, broker, or any individual or entity;
Misrepresenting your identity, role, organization, or credentials during registration or in your profile;
Posting fictitious loads, phantom jobs, or equipment listings for the purpose of data collection or competitor intelligence;
Double-brokering or re-brokering loads without authorization in violation of applicable regulations;
Manipulating the Trust Score system through artificial means, fake activity, or coordinated inflation schemes.
3.3 Harassment, Abuse, and Discrimination
Harassing, threatening, intimidating, or abusing other users through any Platform feature;
Using hate speech, slurs, or content that demeans individuals based on race, ethnicity, religion, gender, sexual orientation, disability, or national origin;
Sharing sexually explicit or graphic violent content;
Stalking, doxxing, or sharing another user's personal information without consent.
3.4 Spam and Unsolicited Communications
Sending unsolicited bulk messages, commercial solicitations, or spam through the Platform's messaging or feed features;
Posting repetitive, low-quality, or automated content designed to flood the feed or listings;
Using bots, scrapers, or automated tools to interact with the Platform without RIG53's written permission.
3.5 Intellectual Property Violations
Uploading or sharing content that infringes any third party's copyright, trademark, patent, or trade secret;
Scraping, copying, or reproducing Platform content, user data, or proprietary RIG53 data without authorization;
Reverse-engineering, decompiling, or disassembling any part of the Platform.
3.6 Security and Infrastructure Abuse
Attempting to gain unauthorized access to any RIG53 system, account, or data;
Probing, scanning, or testing the vulnerability of the Platform without written authorization;
Introducing malware, viruses, or malicious code;
Conducting denial-of-service attacks or any action designed to degrade Platform performance;
Circumventing or disabling any access controls, rate limits, or security measures.
3.7 Privacy Violations
Collecting, harvesting, or storing other users' personal data without their consent;
Sharing, selling, or transmitting Driver Qualification data, CDL records, or other sensitive user information outside the Platform without explicit authorization;
Using another user's personal information beyond the scope of a legitimate Platform transaction.
4. User-Generated Content Standards
4.1 Responsibility for Content
You are solely responsible for all content you post, upload, transmit, or make available through the Platform, including feed posts, load descriptions, job postings, profile content, messages, and documents. RIG53 does not endorse, guarantee the accuracy of, or take responsibility for user-generated content.
4.2 Content License
By posting content on the Platform, you grant RIG53 a non-exclusive, worldwide, royalty-free license to host, store, display, and distribute your content as necessary to operate the Platform. This license does not transfer ownership of your content to RIG53.
4.3 Content Moderation
RIG53 reserves the right — but not the obligation — to review, moderate, remove, or restrict any content that violates this AUP, the Terms of Service, or applicable law. Moderation decisions are made at RIG53's reasonable discretion.
4.4 Accuracy of Commercial Data
Load postings, job listings, equipment listings, and rate submissions must reflect genuine commercial intent and accurate information. Fictitious or materially inaccurate commercial listings are a violation of this AUP and the Terms of Service.
5. DMCA and Copyright
5.1 Copyright Infringement Policy
RIG53 respects intellectual property rights and complies with the Digital Millennium Copyright Act (17 U.S.C. §512). If you believe content on the Platform infringes your copyright, you may submit a DMCA takedown notice to our designated copyright agent.
5.2 DMCA Notice Requirements
A valid DMCA notice must include: (a) a description of the copyrighted work claimed to be infringed; (b) the URL or location of the allegedly infringing content; (c) your contact information; (d) a statement of good faith belief; (e) a statement under penalty of perjury that the information is accurate and you are authorized to act; and (f) your electronic or physical signature.

5.3 Repeat Infringers
RIG53 will terminate the accounts of users who are determined to be repeat infringers of third-party intellectual property rights.
6. Security and System Integrity
6.1 Account Security
You are responsible for maintaining the confidentiality of your account credentials. You must not share your password, allow others to access your account, or use another user's credentials. You must notify RIG53 immediately at security@rig53.com if you suspect unauthorized access to your account.
6.2 Responsible Disclosure
If you discover a security vulnerability in the Platform, you must report it promptly and in good faith to security@rig53.com before public disclosure. RIG53 prohibits the exploitation of discovered vulnerabilities for any purpose.
7. Enforcement
7.1 RIG53's Rights
RIG53 reserves the right to investigate any suspected violation of this AUP. Upon determining that a violation has occurred or is likely occurring, RIG53 may take any of the following actions at its sole discretion:
Remove or restrict any violating content;
Issue a warning to your account;
Temporarily suspend your account;
Permanently terminate your account;
Report the conduct to law enforcement or regulatory authorities;
Seek injunctive relief or other legal remedies.
7.2 No Obligation to Monitor
RIG53 is not obligated to actively monitor all Platform activity or content. Our enforcement rights do not create a duty to monitor, and RIG53 is not liable for any failure to detect or act on violations.
7.3 Cooperation with Authorities
RIG53 will cooperate fully with law enforcement agencies, regulatory bodies, and court orders as required by applicable law, including disclosing user information in response to valid legal process.
8. Account Suspension and Termination
8.1 Immediate Termination Triggers
The following violations will result in immediate account termination without prior notice:
Submitting fraudulent credentials, CDL records, or DQ documentation;
Operating without required FMCSA authority when that authority is a prerequisite for the listed service;
Child sexual abuse material (CSAM) or any content that sexually exploits minors;
Cyberattacks, unauthorized access attempts, or introduction of malware;
Conduct that creates an imminent safety risk to other users or the public.
8.2 Effect of Termination
Upon termination, your right to access and use the Platform ceases immediately. RIG53 may retain data as required by law or legitimate business purposes. Platform credits, subscription fees, and any other amounts paid are subject to the refund policy in the Terms of Service. Termination does not limit RIG53's right to pursue legal remedies for violations.
8.3 Appeals
If you believe your account was suspended or terminated in error, you may submit an appeal within 30 days of the suspension or termination notice by emailing support@rig53.com with the subject line "Account Suspension Appeal." RIG53 will review appeals and respond within 10 business days. Appeals for violations involving illegal activity or fraud will not be reversed.
9. Reporting Violations
If you observe conduct that you believe violates this AUP, you may report it using the in-app report feature on any post, listing, or user profile, or by emailing trust@rig53.com with a description of the violation and any relevant links or screenshots. RIG53 reviews all reports and takes appropriate action, though we cannot guarantee a response to every report.
Submitting false or bad-faith reports is itself a violation of this AUP.
10. Modifications to This Policy
RIG53 reserves the right to modify this AUP at any time. Material changes will be communicated via email to your registered address or via an in-app notice at least 14 days before taking effect. Continued use of the Platform after the effective date of any modification constitutes your acceptance of the revised AUP. The current version is always available at rig53.com/legal/acceptable-use.
